The Service and Security

You are wholly responsible for your use of the this Free Wifi Service. You accept that RLC have no control over the information transmitted via the service and will not be responsible for such information. RLC have no obligations to compensate you for such information and/or such use.

• Any use that infringes Kapua Networks Limited, Rotorua Lakes Council or others' property rights or privacy;
• Applications or actions, which may affect the experience of other users or performance of the Service.
• Your use of the service must comply with all applicable laws, regulations and codes including, but not limited to the Copyright Act 1994, the Crimes Act 1961, the Privacy Act 1993, the Defamation Act 1992 and the Fair Trading Act 1986.

If RLC believe your use of the Service is in breach of these conditions, we may temporarily or permanently, restrict or suspend access to the Service.
You indemnify Kapua Networks Limited and Rotorua District Council from and against any loss, costs and expenses (including all legal expenses) arising from any claims that may be brought against them in respect of your use of the Service.

Consumer Guarantees Act

You acknowledge that if you are acquiring the Service for the purposes of a business the Consumer Guarantees Act 1993 does not apply to the Service and we disclaim any and all warranties whether express or implied including warranties of merchantability or fitness for purpose and exclude any liability or costs of any kind, direct or indirect for any type of loss or damage (including loss of profits and claims by third parties) resulting from your connection to or use of this Free WiFi Service, or the content, or failures, interruption or delays in the supply of the "service" or any negligence in this respect.

RLC's primary goal in collecting personal information from you is to provide you with a smooth, efficient, and personalized experience while using this Free WiFi service. This allows RLC to provide services and features that is more inclined to meet your needs, and to customize this Free WiFi service to make your experience easier and quicker. We may use personal identifying information about you to improve marketing and promotional efforts, to statically analyze site usage, to improve content and product offerings, to customize this Free WiFi landing page content, layout and services to grow Rotorua. RLC may use your e-mail address to send you newsletters and other communications.

RLC stores your information in a secure private server located in Miami, Florida, USA.

Jurisdiction

The laws of New Zealand govern this agreement and you submit to the exclusive jurisdiction of the New Zealand courts.
